Case Update: Parents of child tragically decapitated during birth speak after medical examiner's homicide ruling

Jessica Ross and Treveon Isaiah Taylor, Sr., the parents of a child who tragically died during a difficult birth last summer, spoke Wednesday following news that the death was officially ruled as a homicide by the medical examiner's office.

The Clayton County Medical Examiner's Office said the cause of death was from a "fracture-dislocation with complete transection, upper cervical spine and spinal cord."

It also said that ruling the manner of death as a homicide means the death was caused by the actions of another person. At this time, there is no word on whether charges will be filed against anyone in light of the news. Clayton County Police are still investigating the case.

Lawyers for the family touched on the multiple lawsuits launched behind the death, including against the hospital, which the council alleges attempted to cover up the child's manner of death.

Taylor said, "We want justice for our son; they lied to us." Meanwhile, Ross was next to his side, fighting to hold back tears. She eventually left the room.

"It's been tough on the whole family," one of the lawyers told reporters. "They have been strong and resilient."

The family's legal team also specified that they are still working to depose all those who were in the room at the time of the birth.

11Alive's Molly Oak spoke with the family after the press conference. The parents opened up more about the pain they're dealing with.

"I just want justice for my baby boy. I’m hurt. I’m hurt bad. [The doctor] hurt me. She took my baby," said Ross. "She didn’t show no emotions. I just want justice for my baby."

Both Ross and Taylor said the hospital staff did not allow them to hold their child after delivery. They said not being able to carry their child, one that bears Taylor's name, still causes them pain.

"It hurts, it hurts. Because I wanted to hold him, and they kept telling me no," Ross said as she started crying.

Shaking his head in disbelief, Taylor said he didn't get to touch the infant. He said the delivery process and outcome was "shocking" and still gives him "chills."

"Because they lied to us," Taylor said, saying he's experienced a mix of emotions. "They played in our face. They tried to cover it up. They didn’t tell us the details of what happened."

Both the couple and their lawyers said they want answers and need people to speak up.

"Just come forward, please. The nurses that was in the room. Please just come forward please. I just want justice for my baby," Ross said tearfully.

She thinks about her baby every day and said she doesn't think she will ever heal from this.

I know he's watching over us," Taylor added.

Lawsuit alleges doctor posted photos, video of decapitated newborn

After suffering the horrific loss of their first child during delivery July 10, 2023, parents Jessica Ross and Treveon Isaiah Taylor, Sr. were shocked to learn that the doctor they hired to conduct an autopsy following their baby's death by decapitation secretly recorded graphic video of his medical examination of their baby and posted the video to his Instagram account, all without the family's knowledge or permission.

Ms. Ross and Mr. Taylor filed a lawsuit earlier this week against Dr. Jackson Gates and Gates Rapid Diagnostic Laboratory of Atlanta alleging invasion of privacy, intentional infliction of emotional distress and fraud.

According to the complaint, Ms. Ross paid Dr. Gates $2,500 to conduct a postmortem examination. The contract did not give Dr. Gates permission to film the examination or disseminate video of said examination.

The complaint contends that in addition to suffering the heartbreaking loss of their first child, Ms. Ross and Mr. Taylor were outraged when they learned that Dr. Gates had posted several videos of the grisly and graphic video to his Instagram account. The family's attorneys sent a cease-and-desist letter to Dr. Gates advising him to immediately remove the videos from his account.

"After suffering one of the most heartbreaking losses any family could ever endure, Jessica Ross and Treveon Isaiah Taylor, Jr. had salt poured into their unfathomable emotional wounds when they discovered that video of their baby's very graphic medical examination had been made public by the very doctor they entrusted to conduct the autopsy.

Clayton County mother to announce lawsuit after her baby was decapitated during birth

20-year-old Jessica Ross and her boyfriend Treveon Isaiah Taylor, Sr. were eagerly awaiting the birth of their first child July 9 but were devastated to learn that not only did their baby not survive the delivery, he was tragically decapitated in the process.

Ms. Ross and Mr. Taylor will today announce that they have filed a lawsuit against the doctor, the hospital, several nurses and the medical group who delivered their decapitated baby.

During the attempted vaginal delivery, the baby’s shoulders got stuck in the vaginal canal (shoulder dystocia).

The complaint alleges that the obstetrician, Tracey St. Julian, M.D., negligently applied excessive force on the baby’s head and neck during the attempted vaginal delivery resulting in the baby’s decapitation. It also alleges that Dr. St. Julian and the hospital nurses failed to do a Cesarean section on Mr. Ross in a timely manner, failed to call in a timely manner to get help from other healthcare providers as well as other allegations.

According to the complaint, the baby's legs and torso were delivered through the incision in Ms. Ross’ uterus without the head. The baby’s head was then delivered vaginally.

In the complaint, Ms. Ross and Mr. Taylor also allege that the doctor and the hospital engaged in intentional fraud and an attempt to coverup the fact that their baby was decapitated. More specifically, the complaint contends that Dr. Tracey St. Julian purposefully did not tell Ms. Ross and Mr. Taylor that their baby had been decapitated when she initially spoke with the couple a few hours after the delivery.

Also, healthcare workers at the hospital knowingly lied to the young couple by falsely telling them that a free autopsy was not an option for them under the circumstances. The complaint alleges that this false information was given to avoid a forensic autopsy and to obstruct the gathering of evidence.

Furthermore, the complaint alleges that healthcare providers at the hospital pressured the young couple to cremate their baby in an attempt to destroy evidence.

When the Ms. Ross and Mr. Taylor demanded to see and hold their baby, hospital staff told them that they were not allowed to touch or hold their child. Hospital staff allowed the young couple to only view their dead child, not hold or touch him. During this viewing, their baby was wrapped tightly in a blanket with his head propped on top of his body in a manner such that those viewing him could not identify that he had been decapitated.

Ms. Ross and Mr. Taylor were not told about the decapitation until July 13, 2023, 3 days after the delivery and a full day after Ms. Ross had been discharged from the hospital.

Family Demands Answers in Mysterious Death of 19-Year-Old at Atlanta Detention Center

ATLANTA, GA (July 21, 2023): 19-year-old Noni Battiste-Kosoko was found dead at the Atlanta Detention Center on July 11, 2023 where she had been held since May 20 ^th for a misdemeanor bench warrant.

795,000 Americans a year die or are permanently disabled after being misdiagnosed

Top medical researchers are sounding the alarm that an estimated 795,000 American patients continue to die or become permanently disabled each year because they are being diagnosed with the wrong conditions.

For years, the public hasn't known much about the full scope of medical misdiagnoses that happen in the U.S., according to a new report released by the Johns Hopkins Armstrong Institute Center for Diagnostic Excellence . Until now, estimates of annual incorrect diagnoses have varied widely, the report says.

Now, researchers say an estimated 371,000 patients die and 424,000 are permanently disabled each year because they are incorrectly diagnosed across a range of medical care settings — not just in the family doctor's office.

The estimate "matches data produced from multiple prior studies that focused on diagnostic errors in ambulatory clinics and emergency departments and during inpatient care," the report says.

The enormous numbers of misdiagnoses are a public health emergency, the report's lead author said. “Diagnostic errors are, by a wide margin, the most under resourced public health crisis we face," said Dr. David Newman-Toker, director of the Johns Hopkins diagnostic excellence center.

Medical professionals almost always misdiagnose diseases when a person's symptoms look like possible symptoms for a different condition, Newman-Toker told USA TODAY. The more subtle the symptom appears, the more likely it is the patient's problem will be misdiagnosed, he said.

"We don't miss strokes when somebody is paralyzed on one side and can't talk," he said. "We miss them when they look like something else that's benign."

How often do doctors misdiagnose conditions?

Overall, medical providers misdiagnose diseases about 11% of the time, the report says.

Some diseases are missed at low rates, whereas others are missed more than half the time, researchers found.

On the lower end of the spectrum, only 1.5% of heart attacks are misdiagnosed, researchers found. On the higher end: 62% of spinal abscess are incorrectly diagnosed.

Heart attacks have such a low rate of misdiagnosis "because we're made a sustained investment over decades" on better diagnostic resources and have passed regulations saying they must be put in place, Newman-Toker said.

For spinal abscesses, their rarity contributes to their high rate of misdiagnoses, he said.

Strokes are top problem among misdiagnosed conditions

Researchers found strokes that are misdiagnosed are the most serious problem for patients and their families.

Among all cases of stroke, the condition was missed in more than 17.5% of the time, researchers said.

One of the main reasons for this is because some people only show dizziness and vertigo as a symptom for stroke, which can unfortunately get misdiagnosed as inner ear disease, Newman-Toker said. Or, someone who had a stroke could just have headaches.

Doctors are not currently being trained across the board on how to differentiate dizziness caused by stroke and the same symptom caused by inner ear disease, he said.

Doctors miss these 5 diseases the most, researchers say

Just five diseases account for nearly 40% of all deaths and permanent disabilities stemming from incorrect diagnoses, according to the report.

Because a small number of diseases make up a large share of the problem, researchers say they are hopeful it will be easy for medical care providers to focus their efforts in certain areas.

"It means we can make a lot of headway in a relatively shorter amount of time, without having to boil the ocean," Newman-Toker said.

The report found reducing diagnostic errors by 50% for stroke, sepsis, pneumonia, pulmonary embolism and lung cancer could cut permanent disabilities and deaths by 150,000 per year.

Forest Park City Council Members to file a lawsuit against the city over surveillance

Forest Park City Council members, Latresa Akins-Wells and Dabouze Antoine will be represented by Dr. Rod Edmonds to sue the city and Forest Police Department over surveillance of their homes and movements.

A press conference was held Tuesday morning at the law firm of Edmond, Lindsay and Atkins. Akins-Wells was visibly emotional and could be seen wiping tears from her eyes while Antoine wrapped his arm around her shoulder. Attorney Keith Lindsay of the Edmond, Lindsay & Atkins law firm and members of the Clayton County NAACP, including President Cheryl Synamon Baldwin were also present.

"We’re not here feeling good about the situation. It’s a horrible situation,” said Dr. Roderick Edmond, the council members’ attorney.

Former Forest Park Police Chief Dwayne Hobbs “had set up almost like a task force for the prior four years to survey, spy and really do a stealth surveillance of these two African-American city council people.” The firm handed out copies of an ante litem notice of intent to sue the city of Forest Park and the Forest Park Police Department, sent by certified mail to Mayor Angelyne Butler giving them 30 days to respond.

Akins-Wells said “at least 12” officers had been assigned to the task force, which has since been disbanded. Akins-Wells said, “It hurt me more than anything. That’s where I grew up. I went to elementary, middle and high school there ... and I’m fighting against this type of thing.”

The lawsuit could be filed sometime in the next six months, Edmond said, although he did not yet know whether it would be in state or federal court or both. “If there are federal issues, they will be brought in federal court,” Edmond said, adding that depended on where the evidence takes them.

The firm alleges that, “without reasonable suspicion, probable cause or any sort of warrant, Chief Hobbs, perhaps with the knowledge and support of other government officials in Forest Park, abused government resources to investigate two elected African American council members who challenged his leadership.”

“My heart is broken....if this is what they’re doing to elected officials, what are they doing to regular citizens?", said Antione.

Antoine also mentioned that one day before he took office, a Forest Park police officer came to his job at a local school asking to see his passport. The officer glanced at it and then handed it right back. "As a young African American man in the South, I am very sen sitive to racial profiling. When I wondered if I was being followed, it scared me. Was I going to be arrested? Were the police going to set me up to be convicted of something I did not do? I did not know for sure what was happening. It was a horrible way to live.”

The council members have said they feel that the department took racially-motivated actions under Hobbs referencing to traffic stops near Hispanic churches on Sundays and a investigation conducted by the Clayton News into allegations that the department disproportionately arrested African-Americans for minor marijuana possession. The investigation found that over 80 percent of those arrests between 2015 and 2018 were of African-Americans.

“We have placed the Forest Park Police Department on notice. The specific claims in the lawsuits that we file will be dictated by the information available at the time and will expand during the discovery phase of the lawsuits. We expect the GBI investigation to provide much more context.", stated Edmond.

Clayton County NAACP president, Cheryl Synamon Baldwin said that she "received a call from a white citizen who did not want to tell me his name,” but that he had told her, “’Ms. Baldwin, I just wanted to let you know what they say about blacks being pulled over is true” and that he had seen this from his window.

Baldwin said the man did not want to identify himself out of “fear for his family.”
